If you do not understand these terms and conditions please do not place your order via this site. This document sets out the Terms & Conditions of our supply to you the purchaser of products ordered through the Specslab.co.uk web site. Please read them carefully before you place your order as all accepted orders are bound by these Terms and Conditions.
General
- These Terms and Conditions do not remove or affect your statutory rights at law.
- No binding contract exists between you the customer and Specslab.co.uk until your order has been accepted and confirmed.
- Cancellation of orders is not acceptable once we have started the manufacture of your glasses. As you are placing your order via the Specslab.co.uk site you are entitled at law to a 7-Day 'cooling off' period before the contract is considered 'solid'. The Specslab.co.uk order form has a 'YES' default setting in the 'Please Deliver ASAP' tick box. If this is not unchecked then customers automatically waive their 7-Day cooling off period by requesting an immediate start on their order.
- All products and goods are sold subject to availability and for delivery within 28 days of the order being received.
- These terms and conditions are our trading terms and conditions and cannot be altered or varied by any member of staff unless you the customer receive that variation in writing from Specslab.co.uk.
- Nothing in these Terms excludes or limits our liability for death or personal injury resulting from our negligence or any breach of the statutory implied terms as to title of goods or for fraud or any other liability which by law we are not permitted to limit or exclude. Our maximum liability (and that of our employees, agents and subcontractors) to you in connection with any physical damage caused to your property through the negligence of us (or our employees, agents and subcontractors) will not in any circumstances exceed £1,000. In all other cases, our total liability (including our employees, agents and subcontractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates. In no circumstances will we (or our employees, agents or subcontractors) be liable to you for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.
- We undertake that Specslab.co.uk Directors and employees, shall, at all times, comply with the provisions of the Data Protection Act 1998 in relation to data received from all customers or enquiries received and shall only process personal data received from you where necessary to fulfil contractual obligations.
- All communications between Specslab.co.uk and its customers will only be recognised if in writing and must be sent by first class post, Facsimile or email. (With confirmation received) Any written communication will be treated as having been served on the person receiving it 4 working days after posting (if sent by first class post) or at the time of transmission (if sent by facsimile and a satisfactory transmission report is obtained) or at the time and date stamp if received by email and confirmation of receipt is received by the sending party.
- Any contract entered into via the Specslab.co.uk site is considered personal and applicable to the requesting customer as such it is not to be considered as transferable.
- Specslab.co.uk undertakes to use best endeavour to fulfil its contractual obligations within the specified time agreed, but cannot be held responsible for third party circumstances outside its control.
- 'Next Day Delivery' refers to the day after goods are received at our UK distribution hub. There may be a time delay of 3/4 days to allow for delivery into the UK when goods are produced in our European Laboratories. Our site shows the date goods are shipped from any of our laboratories.
- Specslab.co.uk reserve the right to reassign or transfer the benefit of, or this contract in its entirety to another supplier or interested third party.
- Specslab.co.uk reserve the right to review and amend these terms and conditions as and when circumstances dictate.
